Our dispute resolution expertise

Damage analysis and quantum of damages

Damage analysis is an important step for the parties to decide whether to commence a claim as well as negotiating a settlement, and for the court or arbitral tribunal to decide a judgement or an award. Our team is experienced in economic, financial and forensic analysis, linking factors (such as economic, legal, tax, regulatory etc.) to quantifying damages.

Transaction disputes

More often than not, contractual parties come across unfortunate situations where there is a need to commence a claim (or defending a claim) because of different interpretations of terms, breach of terms, or default in payments. Our team is regularly engaged throughout the deal cycle from advising on complicated transactions and assessing economic benefits, to navigating ways to resolve post-deal disputes and quantifying losses.

International arbitration

As multinational companies and governments increasingly face claims arising from transnational business ventures, investments and project delays, international arbitration has become the preferred means of dispute resolution.

Our international arbitration specialists have dealt with complex quantum and delay issues in treaty and commercial arbitrations, across a wide coverage of industries such as energy, mining, financial services, media, telecommunications, pharmaceutical, transportation, consumer goods, real estate, hotels and leisure, etc.

Business and assets valuation

Very often, a dispute involves assets (sometimes a business), and resolving a dispute hence requires an independent valuation before a distribution or a settlement can be agreed. Our team has extensive experience in valuing a wide variety of assets across industries.

Shareholder claims valuation

Arising out of Cayman Island’s Companies Law section 238, fair value determination of the subject company’s shares is a key part of dissenting shareholders’ claims. Our team has significant involvement in ongoing matters advising a party in a dispute as valuation expert and/or providing second opinion.

Cyber disputes and investigations

Cyber-attacks have become a frequent cause of business interruption. We have seen victims suffer from phishing attacks and malware attacks which resulted in loss of income, disruption to business and theft of corporate and financial information.

Our team is specialised in performing cyber investigations, assessment of quantum of loss, preparing expert reports and responding to the counterparty’s expert reports for all forms of cyber disputes. We also have experience in giving expert evidence in court and arbitration proceedings. In addition, we provide services to host and analyse electronic data for legal or regulatory proceedings.

Cryptocurrency disputes and investigations

The cryptocurrency market is very dynamic and there is no unified inter‑governmental approach to the regulation of cryptocurrencies and other crypto assets. Investors remain wary of the added complexity brought about by crypto asset transactions, for example, commercial disputes over transfers of cryptocurrency or the operation of smart contracts.

Our experienced team can assist you with cryptocurrency or crypto asset-related disputes including corroborating ownership, tracing transactions and coordinating among relevant stakeholders in case of a dispute.

Our team advises on all financial aspects of a marital dispute, from quantifying maintenance needs, asset identification, verification and tracing, to valuations and liquidity analysis for distribution.
